Trading Terms

The following terms apply to all services and products sold and delivered by Bottles With History ApS:

Your access to and use of the website constitutes consent to be bound by these conditions, which establish a contractual relationship between you and Bottles With History ApS. If you do not agree to the Terms, you must not access or use the Website.

Bottles With History ApS can change the terms from time to time. The changes to the terms will be effective after Bottles With History ApS posts such updated terms in the appropriate place. Your continued access to or use of the Website or purchase of our products following such posting constitutes consent to be bound by the amended Terms.

Prices and payment

The applicable price is the one indicated on the item in question on the day of the order. All prices include VAT and are stated in DKK. All our vintage winesare sold with used VAT according to Articles 311-1000 of the VAT System Directive.

Bottles With History ApS is free to change the stated prices without prior notice. If a misprint has occurred and the buyer should know or knows that there is a misprint, the buyer cannot receive the misprinted price. Bottles With History ApS can at any time cancel an order caused by a misprint on the price.

All orders are subject to shipping costs. When ordering, you can see the final price, which includes VAT, taxes and any shipping costs.

PLEASE NOTE: If you live in a country where your government may require additional taxes or duties to be paid for receiving alcohol, you as the customer are responsible for deciding whether to declare this. By purchasing wines from Bottles With History, you assume full responsibility for deciding whether to declare and pay additional duties for your wines, and accepting that Bottles With History will not incur such fees, should they arise.

At Bottles With History ApS, you can pay with Dankort, Kreditkort, MasterCard and MobilePay. Bottles With History ApS only deducts the amount when the order has been sent.

Confidentiality

At Bottles With History ApS we believe that trust and confidentiality are essential for a good collaboration. All information received from you or about you will be treated confidentially, and all employees are subject to confidentiality.

Responsibility

Bottles With History ApS is not responsible for breakdowns or temporary interruptions of our website, breakdowns in power supply or internet connection, vandalism of the system (both physical as well as computer viruses and hacking), misuse of personal data or other conditions and circumstances beyond Bottles With History ApS control. It cannot be guaranteed that you can use downloaded files on all computers, and when using the files it will always be assumed that you have software that can open/read the relevant file.

Product Liability

For such damages which are immediately covered by Act no. 481 of 7. June 1989 on product liability, the provisions of the law apply.
As regards product liability, which is not covered by the provisions of the above-mentioned law, the following restrictions apply:

Bottles With History ApS is only liable for personal injury if it is proven that the damage is due to fault or negligence committed by Bottles With History ApS.

Bottles With History ApS is liable for damage to real property and movable property under the same conditions as for personal injury.

Bottles With History ApS and the customer are mutually bound to be sued in the court or arbitral tribunal that deals with claims for damages brought against either of them based on damage allegedly caused by the material.

Delivery

We deliver with DAO to all of Denmark incl. fixed islands. If you want delivery to non-bridge fixed islands, shipping costs DKK 135.

We ship all orders every Monday and Thursday, so you can expect to receive your order within 1 to 3 business days. We offer delivery of the goods directly to you at your address, via external carriers and to DAO's parcel shops.

If the delivery is delayed, we Bottles With History ApS will inform the customer about this per e-mail.

All products and goods purchased from Bottles With History ApS remain the property of its subcontractors until the time of delivery. This means that the risk of loss and/or damage rests with Bottles With History ApS subcontractors until the time of delivery has taken place. The time of delivery is considered when the goods have been delivered to the carrier.

 

For deliveries outside Denmark

By purchasing wines from Bottles With History, you assume full responsibility for deciding whether to declare and pay additional duties for your wines, and accepting that Bottles With History will not incur such fees, should they arise.

Right of withdrawal

You have a 30-day right of cancellation when you buy goods from us.

The cancellation period expires after 30 days, calculated from the day you receive the item.
NOTE! All orders purchased from 1. November can be exchanged up to and including 31 January.

You must notify us within 30 days of receipt that you wish to cancel the purchase. The notice must be given by Mail at: info@bottleswithhistory.dk

Return

Return of defective or missing goods

In the case of returning goods with faults or defects, where repairs or redelivery are then required, the following procedure will be followed: Please contact us at info@bottleswithhistory.dk and account for the errors and deficiencies in question, using image material.

If we find that there are errors or deficiencies in the delivered product, we will pay for the shipping on the return, for which you will be reimbursed for your return shipping costs.

Return in case of cancellation

You must send your order back to us no later than 30 days after you have received the order. You must pay the costs of returning the item yourself.

When returning, you are responsible for ensuring that the item is properly packed. You bear the risk for the package/goods yourself until we receive it. The postal receipt must therefore be saved as well as anytrack and trace number. You bear the risk for the goods from the time of delivery of the goods.

You are liable for any deterioration in the product's value, which is due to handling other than what is necessary to determine the product's nature, properties and the way the product functions.

Refund of the purchase amount and return of the item

If you regret your purchase, you will get the full amount back, including any delivery costs. However, this does not apply in the following cases: After the expiry of the 30-day right of withdrawal or damage to the products as a result of incorrect use of the product or other damage-causing behaviour.

We will refund your payment no later than the date on which we received notification of your decision to withdraw from this agreement. We reserve the right to withhold the refund until we have received the item back, unless documentation is provided to have returned it.

Right of complaint

The right of complaint does not apply if the defect has arisen as a result of incorrect use of the product or other damage-causing behaviour.

So that you can enter into an agreement with us and shop at bottleswithhistory.dk we need the following information about you: Name, e-mail, address, telephone number and payment information.

The processing takes place according to the rules in our Personal Data Policy.

Choice of law and jurisdiction

Any dispute arising from your purchase through Bottles WIth History ApS as well as on the website or resulting disputes, including the scope or validity of these terms and conditions, is subject to Danish law and must be brought before the Court in Roskilde.
